2. Purpose and Scope

This Legal Notice governs access to, browsing and use of the promotional website planixia.io (hereinafter, the "Website") and the associated cloud application (hereinafter, the "SaaS" or the "Platform").

The status of "User" is granted to any person who accesses, browses or uses the Website or registers on the SaaS. Accessing or using them implies full and unreserved acceptance of each and every one of the conditions included in this Legal Notice.

3. Terms of Use and User Responsibility

The User undertakes to make appropriate, lawful and diligent use of the content and services of the Platform. The following is expressly prohibited:

• Using the SaaS to carry out unlawful or illegal activities, or activities contrary to good faith and public order.
• Introducing or spreading computer viruses, trojans or any other physical or logical system that may cause damage to the servers or systems of the Platform or of third parties.
• Attempting to access, modify or tamper with the accounts, data or messages of other users of the Platform.
• Using reverse engineering, decompilation or disassembly techniques on the SaaS code.

Failure to comply with these obligations will entitle the owner to immediately suspend or cancel the User's account, without any right to compensation.

4. Intellectual and Industrial Property

All intellectual and industrial property rights over the Website and the SaaS (including, without limitation, the source code, graphic design, user interfaces, texts, images, trademarks, logos, colour combinations and database structure) are the exclusive property of PLANIXIA SOFTWARE S.L. or its licensors.

The reproduction, distribution, public communication or transformation of any element of the platform without the express written authorisation of the owner is strictly prohibited. Use of the SaaS grants the User a limited, non-exclusive, non-transferable and revocable licence of use, subject to the Terms and Conditions of Service.

5. Disclaimer of Warranties and Limitation of Liability

The service owner makes every effort to ensure that the Website and the SaaS work correctly and are free of viruses. However, the owner does not guarantee permanent availability or the complete absence of errors on the platform.

To the extent permitted by applicable law, the owner shall not be liable for:

• Temporary interruptions of the service due to maintenance, updates or causes beyond its control (hosting server outages, network problems, etc.).
• Damages of any kind that may arise from the lack of truthfulness, accuracy or currency of the content entered by users themselves in the SaaS.
• Improper, negligent or fraudulent use of the Platform by Users.

6. Changes

The owner reserves the right to modify, update or review the content of this Legal Notice at any time to adapt it to legislative developments or changes in the functionality of the SaaS. Users are advised to review this document periodically.

7. Governing Law and Jurisdiction

Spanish law shall apply to the resolution of all disputes or matters relating to this Website, the SaaS or the activities carried out on them.

Unless the law provides otherwise for specific cases (such as consumer status), the parties expressly agree to submit to the jurisdiction of the Courts and Tribunals of Almería, waiving any other jurisdiction that may correspond to them.
